Capability, not intention. Export control law rests on a principle that long predates the technologies now under debate: an item is dual use when it can serve both civilian and military ends, and the assessment turns on what the item is capable of doing rather than on what its owner intends to do with it.
The framework was built for centrifuges, machine tools and cryptography. It applies with unusual precision to a category its drafters never anticipated, namely the connected robot that moves through a private home.
- What makes a robot dual use is not its function. It is what it can be reprogrammed to do without a single component being touched.
Two governments, one object. On July 16 Moonshot AI released Kimi K3, 2.8 trillion parameters, with the weights following on the 27th. It would be the largest open model ever distributed.
- In the same weeks the US Congress restricted the use of certain Chinese models, and the Pentagon publicly defended the decision.
- Beijing, for its part, is weighing export controls on the weights of its own national models.
- Two governments are therefore moving in opposite directions on the same object. That does not happen with things that do not matter.
The opacity of the weights. Nobody really knows what a matrix of billions of parameters contains. Not the party downloading it, not the party hosting it, not even the laboratory that trained it.
- Open means that every number can be read while nothing at all is known about what the model will do. Inspectability is a guarantee about distribution and a figure of speech about content.
The opacity of the silicon. The same question applies one layer down, and there it is asked far less often. Nobody knows who the camera, microphone and lidar chipsets are talking to: which endpoints they contact at power-on, what travels inside an encrypted packet, which firmware replaces itself after installation.
- The case for Western weights and Western chips does not rest on patriotism. It rests on two functions that a connected device always performs together.
The first function is seeing. Lidar and cameras build a representation of space: centimetre-level floor plans, rhythms of presence, routes, habits, identities. A single remote command can wake the microphones that capture conversation, including the conversations of the politician or the industrial executive whose daughter gave him the small robot for Christmas.
- The precedent is already on the record. In Tehran, the video surveillance network the state had built for internal control was used by someone else to reconstruct the shifts and movements of the leadership’s security detail. The system worked exactly as designed, for a different principal.
- The relevant lesson is not that the network was poorly secured. It is that a sensing infrastructure serves whoever holds its controls at any given moment, and that ownership of those controls is a political variable rather than a technical constant.
The second function is obeying, and it is the one almost nobody examines. A robot is not a camera on wheels. It chooses its frame rather than receiving one, it crosses space rather than observing it, and above all it accepts instructions. A machine operating autonomously also adopts the principles that govern its autonomous behaviour: from whom, under which credentials, over which channel, under which law, and subject to which exceptions.
- To buy a connected robot is to hand over a steering wheel. The only question that matters is where the hand holding it happens to sit.
The scale is wider than it appears. The category begins with the robot that cleans domestic floors, runs through the machines delivering in hospitals and patrolling warehouses, and arrives at the automobile, which is now a robot in every meaningful sense.
- Drive-by-wire has replaced the mechanical linkage. Steering, braking and acceleration are electronic commands, and in a software-defined vehicle a remote update can alter pedal response and the braking curve.
- The wheel held by the driver is a sensor forwarding a request. Whoever writes the firmware decides how that request is translated into motion. This is not a metaphor but an architecture, and it is already deployed at scale on European and American roads.
Washington’s eighteen months. The United States has drawn the operational consequences at speed, seeking visibility into an opacity now distributed throughout its citizens’ homes.
- Drones came first, with DJI placed on the FCC covered list. Routers followed, with TP-Link. Then came connected vehicles, through the Biden administration’s restrictions on cars carrying Chinese hardware and software.
- In June 8 the Pentagon’s 1260H list reached the sensors themselves, naming the lidar manufacturers RoboSense and Hesai. The robots followed, with Unitree.
The listed sensor is already in the home. The 1260H entry reads as a matter concerning military-adjacent hardware. The commercial record says otherwise. These are not exotic components reserved for autonomous trucks and battlefield platforms.
- They are the standard perception layer of the domestic robot, the same sensor family that maps living rooms, corridors, hospital wards and back gardens, and it is entering European and American homes at a rate that no policy discussion has yet registered. The consumer brands that mount it are a matter of public record and a search engine away.
- RoboSense shipped 185,500 lidar units to robotics customers in the first quarter of 2026 alone, more than half its total volume and the first quarter in which robotics exceeded its automotive business. Hesai delivered over 300,000 units of its miniature series within roughly a year of launch, holds an order for up to ten million units from a single consumer robotics group, and is scaling annual capacity beyond four million units.
- The same Hesai unit equips the humanoid robots Unitree presented at China’s Spring Festival Gala, before a peak audience of some 400 million viewers.
- One component family therefore spans the humanoid on Chinese state television, the scrubber working a hospital corridor at night and the vacuum crossing a living room floor in Ohio.
- These are consumer volumes rather than defence volumes: robotic lawn mowers alone reached 2.343 million units shipped globally in the first half of 2025 according to IDC, and domestic cleaning is a larger and older category. The Pentagon did not list a niche defence supplier. It listed the eyes of the machines already circulating inside Western houses.
- In Canada the Federal Court upheld the wind-up order against Hikvision without any party being required to demonstrate harm. The standard applied was capability, not incident, which is precisely the standard the dual-use framework has always used.
What a coherent posture requires. Any robotics company with ambitions in the American market needs three things in place, and the sequence matters because each becomes more expensive the later it is addressed.
- NDAA-compliant electronics, because a bill of materials redesigned after the fact costs roughly ten times what it costs to design correctly at the outset.
- A fleet-learning metabolism located firmly within Western jurisdiction, because this is where the criteria governing robot autonomy are actually defined, and because the entity that holds the learning loop holds the behaviour of the fleet.
- Proprietary inference models rather than weights of unverifiable provenance, which closes the circle back to where the argument began.
The bottom line: This is not compliance arriving ahead of schedule. It is the recognition that a machine which moves through a home is not a service being purchased but an access being granted.
